Letter to the Hon Dr Gabriel Cavallo, 29 March 2001.
De nuestra mayor consideración:
Con profunda satisfacción nos enteramos de su sentencia del 6 de marzo de 2001, en relación a la causa Nro. 8686/2000 carátulada "Simón, Julio, Del Cerro, Juan Antonio s/sustracción de menores de 10 años".
La misma realiza un profundo análisis histórico en relación a los crímenes de lesa humanidad, la competencia del Derecho Internacional y la jurisprudencia relativa al tema.
En nuestra perspectiva la sentencia, en el ámbito jurídico, contribuye, de manera señera, a posibilitar la justicia en relación a crímenes que en diferentes países de América Latina, han escapado a la órbita judicial por decretos o leyes del mismo tenor que las de Punto Final y de Obediencia debida que, según su sentencia "llevan consigo una nulidad insanable".
Indudablemente, su sentencia no es sólo un avance significativo en el campo de lo jurídico. Es, asimismo, una contribución a la consciencia ética de la sociedad argentina y de la latinoamericana en su conjunto. En reiteradas oportunidades, el Consejo Mundial de Iglesias ha señalado la estrecha vinculación existente entre el ámbito de lo jurídico y el ámbito de lo ético, en lo que atañe a violaciones de los derechos humanos, su juicio y la impunidad.
Con pertinencia, la sentencia recoge algunos párrafos de documentos eclesiásticos (Cf. e.g. la alusión a la Constitución Gaudium et spes en V. d. La valoración jurídica que hace la ley. La obediencia jerárquica y sus límites) que manifiestan la preocupación compartida que las iglesias han tenido sobre esta problemática.
Sabemos lo difícil que significa en el marco actual de las sociedades latinoamericanas una sentencia de esa naturaleza. Por eso lo felicitamos por su coraje, por el amor a la justicia que revela la sentencia y, si bien aún queda mucho trecho por andar, consideramos que su contribución ha sido significativa en el proceso de justicia y reconciliación de la nación argentina.
Cuente con nuestro apoyo y nuestra oración para su gestión en estos momentos tan apremiantes en su país, que tiene resonancia que sobrepasa fronteras nacionales.

We have received with great satisfaction the news of the sentence you have handed down on 6 March 2001 in case no. 8686/2000 "Simon, Julio, Del Cerro, Juan Antonio for separation of minors of 10 years of age".
This judgment contains a deep historical analysis of crimes against humanity and the application of international law and jurisprudence relative to this matter.
From our perspective the sentence contributes objectively in the juridical realm to the possibility of justice related to crimes that have evaded the judicial sphere in different countries of Latin America as a result of decrees or laws similar to those of "Punto Final" (Ed. "the end of the matter") and of due obedience that according to your finding "carry in them an unhealthy nullity".
Undoubtedly, your sentence is not only a significant advance in the field of jurisprudence. It is also a contribution to the ethical conscience of Argentine society and that of Latin America as a whole. The World Council of Churches has repeatedly called attention to the close relation between the juridical and ethical realms in that which pertains to violations of human rights, their judgment and impunity.
Pertinently, the sentence contains some paragraphs of ecclesiastical documents (e.g. the allusion to the Constitution Gaudium et Spes in "The juridical valuation that makes law. Heierarchical obedience and its limits") that manifest the shared concern that the churches have expressed on this problematic.
We know the difficulty that a sentence of this sort poses in the contemporary context of Latin American societies. For this reason, we congratulate you for your courage, for the love of justice that this sentence reveals and, even though there remains a long road to travel, we consider that your contribution has been significant in the process of justice and reconciliation in the Argentine nation.
We assure you of our support and our prayer for your initiative in these critical times in your country that has a resonance that spans national borders.
